Hello everybody! After a long time, we are back stronger than ever and with a very significant change for Babyclon®, and most importantly, for all of you who are part of this great family.

We are back with a completely revamped Babyclon® website!

We needed a change in terms of design, ease of navigation and most importantly, to be closer and more in touch with all of you, because thanks to this, Babyclon® is the benchmark brand today.

The main changes are that it is now easier to navigate through our website, simpler but more effective. You can see all the models available in catalogue mode, with links to choose the hair and eye colour and also all the extras available.

And if you want to place an order, you only have to contact us and our secretary Roger will be happy to assist you and help you throughout the purchasing process, solving all your doubts and advising you with the best options.

Now, the website is clearer, everything is more accessible and all the information you need is here, without forgetting the sections of photos and videos of our models, available courses and, of course, our favourite section, the Babyclon® blog!

LEGAL BASES FOR PARTICIPATION IN THE PROMOTION

1.- COMPANY ORGANISING THE PROMOTION

The company CLONFACTORY S.L.U with registered office at calle General Prim, 7, 43580, Deltebre, Spain and identification number B95831988 through its registered trademark BABYCLON® organises for promotional purposes the prize draw (hereinafter, “the Promotion”) at national and international level, to be held over the Internet, exclusively for users of legal age in accordance with the provisions of the section on conditions for participation.

2.-START DATE AND END DATE

The Promotion will begin on 09/07/2021, and will end on 31/07/2021 at 23:59h. Any participation outside this date will be excluded.

3.- PARTICIPATION REQUIREMENTS AND MECHANICS OF THE PROMOTION

The participation requirements for Facebook are as follows:

– All persons over 18 years of age will be eligible to participate.
– Only participants who have a Facebook account and follow the Babyclon® Facebook page will be able to participate.
– Participants may only participate with a single Facebook profile. If a Participant is found to be participating with multiple Facebook profiles, they will be disqualified.
– Participants must comment on the Babyclon® brand publication on the Facebook social network by tagging [3 friends] during the participation period.
– The application will accumulate mentions of the same Participant even if they are in different comments.
– Participants must like the Babyclon® brand’s Facebook post.
– Participants must share the Babyclon® brand post on their profile.

The participation requirements for Instagram will be as follows:

– Those over the age of 18 are eligible to participate.
– Only participants who have an Instagram account and follow the Babyclon® page on Instagram are eligible to participate.
– Participants may only participate with a single Instagram profile. If a Participant is found to be participating with multiple Instagram profiles they will be disqualified.
– Participants must comment on the Babyclon® brand publication on the Instagram social network by tagging [3 friends] during the participation period.
– The application will accumulate mentions of the same Participant, even if they are in different comments.
– Participants must like the Babyclon® brand’s Instagram post.
– Participants must share the Babyclon® brand publication on their Instagram stories tagging @babyclon_oficial.

4.- CONDITIONS OF THE PROMOTION AND PRIZES

1 winner and 2 alternates will be chosen randomly through the SocialGest platform. The winner will be notified on 2 August 2021 through the brand’s social profiles, together with the certificate of validity of the draw.

The prize will consist of the choice of one of the 2 Luanda Preemie models in the photo attached to the prize draw publication. The prize cannot be exchanged for cash or any other prize, nor can it be exchanged or altered.

The holding of the draw and the awarding of the prize are subject to the tax regulations in force.

5.- LIMITATIONS

If it becomes evident that any of the participants do not comply with the requirements demanded in the Bases, or the data provided to participate are not valid, their participation will be considered null and void and they will be automatically excluded from the Promotion, losing all rights to the prizes awarded by virtue of this Promotion.

The following persons may not participate in the Promotion: (i) Employees employed by any of the companies and other entities with legal personality linked to CLONFACTORY S.L.U (ii) Natural persons who participate directly or indirectly in the capital of CLONFACTORY S.L.U(iii) Any other natural person who has participated directly or indirectly in the organisation of this Competition or has been directly or indirectly involved in its preparation or development (agency, suppliers, etc.).

The prize awarded will not be transferable or subject to change, alteration or compensation at the request of the Participants, and may not be exchanged for any other product or money.

CLONFACTORY S.L.U. reserves the right, in the event of just cause and prior legal notice, to make any changes, suspend or extend this Promotion.

The winner will be responsible for any fiscal or tax charges that the acceptance of the prize may entail, as well as any other expenses arising from the promotion that are not expressly assumed by CLONFACTORY S.L.U. in these Legal Bases.

A period of FIFTEEN (15) calendar days is established from the date of the awarding of the prize, in order to make any justified claim. CLONFACTORY S.L.Use reserves the right, if necessary, to substitute the prize for another of similar characteristics.

6.- PUBLICATION OF COMMENTS OR OPINIONS

Comments or opinions whose content is considered inappropriate, offensive, insulting or discriminatory or which could infringe the rights of third parties will not be allowed. Comments against an individual that violate the principles of the right to honour, personal and family privacy and the right to one’s own image will not be allowed. We shall not be held responsible for any damage caused by the comments made by participants in the Promotion, which may at any time offend the sensibilities of other participants.

The participation in this Promotion, as well as the publication of the comments made by the Participants in the publications may not violate under any circumstances the Instagram and Facebook Community Rules or the Instagram Terms of Use. And Facebook

7.- DISCLAIMER OF LIABILITY

By way of example, but not limitation, we are not responsible for possible losses, theft, delays or any other circumstance attributable to third parties that may affect the development of this Promotion, nor are we responsible for the use made by the participant with respect to the prize obtained from this Promotion, and we do not assume any responsibility for any damage or harm of any kind that the Participants, winner or third parties may suffer.

We do not assume responsibility in cases of force majeure or fortuitous event that could prevent the Promotion from taking place or the total or partial enjoyment of the prize. In the event that this Promotion cannot be carried out, either due to fraud detected in the same, technical errors, or any other reason that is not under the control of CLONFACTORY S.L.U. and that affects the normal running of the Competition, we reserve the right to cancel, modify or suspend the same, including the participation website.

8.- FACEBOOK/INSTAGRAM

The promotion is not sponsored, endorsed, administered by, or associated in any way with Facebook/Instagram and Participants release Facebook from all liability for any damages arising therefrom.

9.- PROTECTION OF PERSONAL DATA

CLONFACTORY S.L.U takes the protection of your privacy and your personal data very seriously. Therefore, your personal information is kept securely and treated with the utmost care.

In accordance with the provisions of the applicable regulations on data protection, and specifically Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, each Participant, by accepting these Legal Bases consents to the personal data provided for participation in this competition being incorporated into a file owned by CLONFACTORY S. L.U. in order to process the participation in the competition and to communicate the prize in the event of being the Winner.

We inform you that your personal contact details will be used for the following purposes:

Participants guarantee that the personal data provided are truthful and are responsible for communicating to CLONFACTORY S.L.U, any changes thereto. CLONFACTORY S.L.U. reserves the right to exclude from this promotion any Participant who has provided false information. CLONFACTORY S.L.U. cannot be held responsible for any unlawful theft, modification or loss of data.

Participants have the right to (i) access their personal data, as well as (ii) request the rectification of inaccurate data or, where appropriate, request its deletion, (iii) request the limitation of the processing of their data, (iv) oppose the processing of their data and (v) request its portability. Without prejudice to any other administrative or judicial remedy, the Participant shall have the right to lodge a complaint with a Supervisory Authority, in particular in the Member State in which he/she has his/her habitual residence, place of work or place of the alleged infringement, in the event that he/she considers that the processing of his/her personal data is not lawful, as well as in the event that the exercise of his/her rights is not satisfied.

The Supervisory Authority with which the complaint has been lodged will inform the complainant of the course and outcome of the complaint.

10.- CHANGES

We reserve the right to modify or extend these promotional terms and conditions, to the extent that it does not prejudice or undermine the rights of the participants in the Promotion.

11.- APPLICABLE LAW AND JURISDICTION

These legal bases shall be governed in accordance with Spanish law. The courts and tribunals of the city of Tortosa (Tarragona) shall have jurisdiction to settle any claim or dispute that may arise in relation to the validity, interpretation or fulfilment of these terms and conditions.
